TERMS OF USE.

The plain-English version: Use MateSync legally and respectfully. Don't share your account, don't try to break the app, and treat your mates' roster info with care. We'll do our best to keep the service running but can't guarantee perfection. Australian Consumer Law gives you certain guarantees we can't override, and we don't try to. If something goes wrong, email us at hello@matesync.au.
01Agreement
These Terms of Use ("Terms") are an agreement between you and MateSync ("we", "us", "our"). They apply when you:
- Visit matesync.au
- Join the MateSync waitlist
- Use the MateSync mobile application (when launched)
- Communicate with us by email or otherwise
By doing any of the above, you accept these Terms. If you don't agree, please don't use the service.
These Terms should be read together with our Privacy Policy, which forms part of this agreement.
02Eligibility
To use MateSync you must:
- Be at least 16 years old (we may raise this to 18 once the Children's Online Privacy Code takes effect)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the service under Australian law or the laws of your country of residence
If you're using MateSync on behalf of an organisation (for example, a workplace coordinating shift schedules), you confirm you have authority to bind that organisation to these Terms.
03Your account
When the app launches, you'll be able to create an account using your phone number or email address.
Your responsibilities
- Provide accurate information when signing up and keep it up to date
- Keep your login credentials secure and don't share them
- Notify us immediately if you suspect unauthorised access at hello@matesync.au
- Be responsible for all activity that occurs under your account
One person, one account
Each account is for one person. You can't share your account, sell it, or transfer it. The whole point of the app is that everyone owns their own roster — it doesn't work if accounts are shared.
04Using MateSync
You agree to use MateSync only for its intended purpose: coordinating schedules with your own mates, family, and connections. Specifically, you must not:
- Use the service for any illegal purpose or in breach of any law
- Add someone as a "mate" without their genuine consent — invitations should only be sent to people you actually know
- Harass, abuse, intimidate, or harm any other user
- Impersonate another person or misrepresent who you are
- Attempt to gain unauthorised access to another user's account, roster data, or any part of our systems
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use automated tools (bots, scrapers, etc.) to access or interact with the service
- Resell, sublicense, or commercialise the service or its data
- Use the service to send unsolicited marketing or spam
- Upload or transmit viruses, malware, or anything else designed to disrupt the service
- Interfere with the operation of the service or its servers
Breach of these rules may result in immediate suspension or termination of your account.
05Your mates' data
When you connect with a mate, you'll see their roster on/off pattern. This is sensitive personal information about their work and movements. You agree to:
- Keep their roster private — don't screenshot it and share with others, post it publicly, or use it for any purpose other than coordinating with them
- Respect their employer's policies — many FIFO and shift-work employers have policies about discussing rosters publicly. We can't enforce these policies but we expect you to know and respect them
- Disconnect from people who don't want to share — if a mate asks you to disconnect, do so promptly via the app
- Not use roster data to harm anyone — for example, by stalking, harassing, or working out when someone's home or away for malicious purposes
Misuse of mate data is grounds for immediate account termination, and may also be unlawful under stalking, harassment, or doxxing laws.
06The waitlist offer
The first 100 people to join the MateSync waitlist will receive 6 months of MateSync Pro free, starting from the date the app launches. The fine print:
- Your position is determined by the timestamp on Netlify's records of your signup. We'll do our best, but if there's any technical issue we'll make the call in good faith
- You must use the same email address on the waitlist as on your eventual MateSync account, or otherwise verify your eligibility
- The 6-month free Pro period starts when the app launches, not when you joined the waitlist
- After the 6 months end, your account will revert to the Free tier unless you choose to subscribe to Pro
- The offer is non-transferable, non-refundable, and has no cash value
- If MateSync is delayed, cancelled, or never launches, no compensation is owed — this is a free pre-launch offer
- We may change or end this offer at any time before launch with reasonable notice via email
07Subscriptions & payments
When the app launches, MateSync will offer a Free tier and a paid Pro tier.
Pro subscriptions
- Subscriptions are processed by Apple (App Store) or Google (Google Play), not by us directly. Their respective terms also apply
- Prices are shown in your local currency where supported, otherwise in Australian dollars
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- You can cancel your subscription at any time in the App Store or Google Play settings — cancellation takes effect at the end of the current billing period
- Refunds are handled by Apple or Google according to their refund policies. We'll do our best to help with refund requests but cannot process them directly
Price changes
If we change subscription prices, we'll notify you at least 30 days in advance by email or in-app notification. Existing subscribers will continue at their current price until the end of their current billing period.
08Our rights
Intellectual property
MateSync, including the app, this website, the brand, the logo, and all content we create, is owned by us. You can use the service for its intended purpose, but you don't get any ownership of our intellectual property.
Your roster data and the data you put into the app remains yours. You grant us a limited licence to host, display, and process it solely to provide the service to you and your connected mates.
Service changes
We may add, change, or remove features over time. We'll do our best to give notice for material changes (especially if a feature you rely on is being removed), but the service will evolve.
Right to suspend or terminate
We may suspend or terminate your access to the service at any time for breach of these Terms or for any reason permitted by law. Where reasonable, we'll give you notice and an opportunity to fix the issue.
09Warranties & disclaimers
We provide MateSync on an "as is" and "as available" basis. To the maximum extent permitted by law, we don't warrant that:
- The service will be uninterrupted, timely, secure, or error-free
- Roster calculations will always be accurate (especially if you've entered the wrong start date or pattern)
- The service will meet your specific requirements
- Any information shown is reliable enough to make important decisions on without verification
Don't book non-refundable flights or make critical plans based solely on the app's roster predictions. Always confirm with the actual person before committing to anything significant. Roster patterns change, anchor dates can be wrong, and software has bugs. Use MateSync as a helpful tool, not as gospel.
10Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy that you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law where to do so would be illegal or void.
If MateSync is supplied to you as a "consumer" under the ACL, you have certain consumer guarantees that cannot be excluded. These include guarantees that the service will be:
- Provided with due care and skill
- Reasonably fit for any specified purpose
- Provided within a reasonable time
Where any provision of these Terms would otherwise contravene the ACL, that provision applies only to the extent permitted by law. Any liability we have for breach of a non-excludable consumer guarantee is, where the law allows, limited to:
- Re-supplying the service, or
- Paying the cost of having the service supplied again
11Limitation of liability
Subject to section 10 (Australian Consumer Law), and to the maximum extent permitted by law:
- We are not liable for any indirect, consequential, incidental, or special loss or damage arising from your use of MateSync
- This includes loss of profits, loss of data, loss of opportunity, loss of goodwill, business interruption, or personal injury (other than where caused by our negligence and not excludable)
- Our total aggregate liability to you for any claim relating to MateSync is limited to the greater of: (a) the amount you have paid us in the 12 months preceding the claim, or (b) $100 AUD
You agree to indemnify us against any claim, loss, damage, or cost (including legal fees) arising from your breach of these Terms or your misuse of the service, except to the extent caused by our own negligence or wrongdoing.
12Termination
You can leave anytime
You can stop using MateSync at any time. To delete your account and data, email hello@matesync.au or use the in-app delete option (when available). Deletion takes effect within 30 days, after which most personal information is permanently removed.
If we end your access
If we suspend or terminate your account for breach of these Terms, you lose access immediately. We may keep limited records (e.g. of the breach) for legal and security reasons.
Surviving sections
The following sections survive termination: 5 (Your mates' data), 8 (Our rights), 9 (Warranties), 10 (Australian Consumer Law), 11 (Limitation of liability), and 14 (Governing law).
13Changes to terms
We may update these Terms from time to time. When we do:
- We'll update the "last updated" date at the top of this page
- For material changes (changes to your rights, pricing, or how the service works), we'll notify you by email or in-app at least 14 days before they take effect
- If you keep using the service after a change, you accept the updated Terms. If you don't agree, you can stop using the service before the change takes effect
14Governing law
These Terms are governed by the laws of South Australia, Australia. You and we both submit to the non-exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia for any dispute arising from these Terms or the service.
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect.
